Organizations have a growing number of reasons to demonstrate compliance with privacy laws and regulations. Article 22 of the EU General Data Protection Regulation, as currently written, will require businesses to ensure that their processing activities comply with the requirements of the Regulation and to demonstrate that compliance to Supervisory Authorities. Under the current EU Directive, Binding Corporate Rules require organizations to monitor compliance across the group, report results to the management board, and be prepared to share results with Data Protection Authorities on demand. That obligation will continue under the Regulation. Organizations that are subject to U.S. Federal Trade Commission Consent Orders have an ongoing obligation to demonstrate compliance with the requirements of the Order. Even where there is no explicit legal requirement to demonstrate compliance, Regulators in jurisdictions around the world are calling for it through papers and guidance documents (for example Canada, Hong Kong, Colombia, and Australia).
