Introduction to PIPEDA
Jurisdiction
Canadian organizations involved in commercial
activity are governed by the Personal Information
Protection and Electronic Documents Act (PIPEDA)
unless they are located in a province that has enacted
privacy legislation that has been deemed substantially
similar.
Note:
- Federal works
are always governed by PIPEDA regardless of location.
- PIPEDA applies to all personal information (not
employee personal information) in any interprovincial
and international transborder data flow.

Employee Privacy
Does PIPEDA apply for Employee privacy?
- Yes, however PIPEDA only applies to employee data
if you are an organization regulated as a federal
work. Application of the Act is outlined in
PIPEDA [s.4.1(b)].
- Employee privacy is a legislative requirement
in British Columbia, Alberta, and Quebec.
