this to become an annual event.

want to know who is taking privacy seriously, who is
making the investment and who is establishing best-practices.

of a Corporation's Commitment to Privacy
Clear and complete disclosure of an organization's
personal information policies and practices provides
consumers notice that allows them to make informed
choices, a requirement in privacy laws and privacy
standards. It also provides consumers with
information and options when the organization
is already a custodian of the consumer's personal
information.
The
quality of an organization's notice to consumers
can be measured based on industry-defined best-practices.
Nymity's Canadian
Notice Index has a complete listing of effective
notice provisions in Canada. A sub-set of

2006 Trends
in Transparency Report
Research by Nymity
Identifying the top privacy policies in Canada is an
extensive research project that allows for the creation
of Nymity's 2006 Trends in Transparency Report.
This report provides and in-depth understanding
of:
- transparency provisions found in top privacy policies
in Canada;
- advanced notice observations by industry;
- best practices in policy structures, including
multi-layer notices;
- strategies used to build consumer trust;
- language usage, legalese versus common language;
- the use of privacy seals;
- advanced notice considerations, including such
areas as:
- cross-border transfers of personal information;
- outsourcing;
- consent;
- call recording;
- access requests;
- resume collection.
- security provisions found in privacy policies;
and
- advanced risk mitigation strategies.
The report will provide detailed statistical analyses,
covering areas such as:
- advanced notice considerations;
- industry transparency;
- notice structures; and
- length of privacy policies.
The report will be made available with the announcement
of Nymity's 2006 Top Privacy Policies in Canada, for
a fee.
Ranking
Criteria and Process
Rankings are based on an empirical process, specific
criteria and not subject to opinions or bias.
- The 2005 ranking is based on 70 Notice Considerations
found in the Canadian
Notice Index. The 2006 ranking will be based on
an updated set of Notice Considerations.
- Ranking is completed by Nymity's research lawyers,
experts in Notice provisions, using a specific methodology.
- Ranking is based on transparency, not on content.
For example, an organization that stated several
uses of personal information for secondary purposes
would rank equal to an organization that stated they
didn't use personal information for secondary purposes.
The key is providing notice on this matter.
- Ranking is for online privacy policies on Canadian
Web sites only. Privacy policies refers to notices
available online relating to an organization's personal
information management practices. This includes,
but is not limited to, privacy statements, privacy
codes, privacy brochures and privacy promises.
- An organizations need not be a Nymity customer to
be ranked. No bias is given to Nymity's customers,
in fact, the research team does not know which organizations
are Nymity customers.
- Ranking criteria are openly available to subscribers
of the Canadian
Notice Index.
- Nymity uses best efforts to analyze all organizations
in each industry. We use a combination of industry
listings from business associations and magazines
to identify organizations. Anyone can nominate
an organization for future rankings by contacting
Nymity by email at info@nymity.com,

- Nymity publishes only the best privacy policies
and does not disclose organizations who rank low based
on the criteria. Nymity however, reserves the
right to share the complete list of rankings with
regulatory bodies, for example, the Office of the
Federal Privacy Commissioner.
- Only Nymity can use the Canadian
Notice Index for ranking purposes.
