While Mexico has had data protection laws in place for some time, Mexico is in the midst of upgrading its data protection and privacy law into a more rigorous regulatory framework and culture. In doing so, there are important highlights of the timeline, law and proposed regulations and regulatory structures for those of us who do business in Mexico to know about, especially in 2011 and 2012. When we know about the time line, the law and proposed regulations then the processes for the regulatory system and compliance becomes much simpler.

Oscar de la Vega and Adolfo Athié Cervantes, partners and attorneys with Basham, Ringe y Correa, S. C. in Mexico, are very experienced in these matters and they provide us with these key highlights and the expected timeline. They highlight the unique aspects of data protection today and in the coming years in Mexico as well as some of the major risks and more importantly mitigating controls that are necessary for those of us that do business in Mexico.
