The Current Importance of Implementing Data Protection in Ukraine

In January 2011, the new Law on Personal Data Protection came into force in Ukraine. The Law and the respective regulations that have been put in place are not available in any official translations other than in their original Ukrainian-language versions.
Counsellor Oksana Voynarovska and associate Vladyslav Podolyak of Vasil Kisil & Partners, Ukraine, are experienced in these matters and have provided us with the key highlights of the process of implementing data protection in 2011 and beyond. They have outlined the unique aspects of data protection today and in the coming years in Ukraine and have spoken about some of the major risks and, even more importantly, about the mitigating controls that are necessary for those of us who do business in Ukraine.
Oksana Voynarovska has active practice in civil law, product liability and data protection, as well as civil and commercial litigation. She has been advising both multinational and domestic companies on privacy law since 2001. She has also been contributing to international surveys and questionnaires, drafting template documents for clients and providing legal opinions. Mrs. Voynarovska has authored a number of articles about data protection in Ukraine.
Vladyslav Podolyak focuses on civil and commercial litigation. Mr. Podolyak has extensive experience in privacy law and is one of the experts at the Public Advisory Council of the Ukrainian Data Protection Authority (the “DPA”). Mr. Podolyak is co-author of the draft Corporate Code of Conduct on Protection of Personal Data in IT that is being developed by the European Business Association (Kyiv, Ukraine), a Ukrainian organisation that brings together more than 800 European, Ukrainian and multinational companies.
